勞動者辭職注意事項(xiàng)
一、辭職是法律賦予勞動者的絕對權(quán)
1、試用期內(nèi),提前三日,可口頭通知。
應(yīng)注意保存好已經(jīng)通知用人單位的相關(guān)證據(jù),可適當(dāng)錄音或者提供人證。
2、試用期已過或沒有約定試用期的,提前三十日,并且只能以書面形式通知。應(yīng)注意《辭職單》等應(yīng)讓用人單位簽收,自己復(fù)印一份;如果用人單位不簽收,可通過快遞或掛號信形式發(fā)出,并且快遞或掛號信要體現(xiàn)辭職的相關(guān)信息。
3、只需提前通知,無需征得用人單位同意。
用人單位以公司訂單多、招不到人、合同期未滿等為由不同意、不批準(zhǔn)勞動者辭職是不符合法律規(guī)定的,因?yàn)檗o職是勞動者擁有的絕對權(quán)利,而非相對權(quán)。勞動者依法定程序向用人單位提出辭職后,屆時要求用人單位辦理離職手續(xù)的,用人單位應(yīng)配合辦理。
二、辭職理由要據(jù)實(shí)填寫
1、辭職理由決定——能否立即解除勞動合同
如果用人單位有未及時足額支付勞動報酬、未依法為勞動者繳納社會保險費(fèi)以及以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫勞動等《勞動合同法》第三十八條規(guī)定情形的',勞動者可以立即解除勞動合同,不需提前通知用人單位。如果勞動者在辭職理由上填寫的是“回老家”或者“個人原因”等,則需提前三日或者三十日通知用人單位才可解除。
2、辭職理由決定——能否獲得經(jīng)濟(jì)補(bǔ)償或賠償
勞動者符合《勞動合同法》第四十六條規(guī)定、第八十七條規(guī)定,可以要求用人單位支付經(jīng)濟(jì)補(bǔ)償金或者賠償金。經(jīng)濟(jì)補(bǔ)償按勞動者在本單位已經(jīng)工作的年限,每滿一年支付一個月工資的標(biāo)準(zhǔn)向勞動者支付,賠償金是補(bǔ)償金的二倍。但是如果辭職理由寫的是“回老家”或者“個人原因”等的,之后再向勞動仲裁委或法院要求用人單位支付經(jīng)濟(jì)補(bǔ)償金或賠償金的,一般不會得到支持。
三、勞動者未按法律規(guī)定離職要承擔(dān)賠償責(zé)任
勞動者違反《勞動合同法》規(guī)定,未提前三日或未提前三十日通知用人單位,要求用人單位解除勞動合同、辦理相關(guān)離職手續(xù)的,用人單位可以不予辦理。勞動者違法解除勞動合同而給用人單位造成經(jīng)濟(jì)損失的,應(yīng)當(dāng)依據(jù)有關(guān)法律、法規(guī)、規(guī)章的規(guī)定和勞動合同的約定承擔(dān)相應(yīng)賠償責(zé)任。
